PRIVACY NOTICE

BACALAR BEACH CLUB

 

In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter identified as the "Personal Data Law"), BACALAR BEACH CLUB (hereinafter identified as the "SELLER") issues this document according to the following:

I. Identity and address of the person responsible for the processing of your personal data


The SELLER, as responsible for the processing of personal data, indicates the address located at Costera Bacalar Sur 605, Bacalar, Quintana Roo, Mexico. 77930.

The Area responsible for the personal data collected by the SELLER and where you can contact for the purposes of the rights established in the Personal Data Law itself, is the Sales Coordination, located at the address indicated in the previous paragraph or in the email: contaco@bacalarbeachclub.com.

II. Obtaining and purposes of processing your personal data

In accordance with the regulations and bylaws of the SELLER that regulate the activities and services it provides, the SELLER may collect your data personally or through different sources, either directly or indirectly.

The personal data that the SELLER collects, including, where appropriate, personal, patrimonial and/or sensitive data, will be used for the following express, analogous or compatible purposes, which give rise to or are necessary to maintain the legal relationship between the SELLER and the owner of the personal data.

  1. Provide the services or sell the products that the SELLER can provide or sell in terms of the regulation that is applicable to it and its bylaws;

  2. Inform about products or services that are related to contracted or acquired by the owner in his capacity as a client, as well as changes to them;

  3. Comply with obligations contracted with the owner;

  4. Comply with regulatory obligations issued by the competent authorities, as well as meet their requirements;

  5. Keep your information up to date;

  6. Inform about new products or services; and

  7. Evaluate the quality of the service;

The Personal and/or Sensitive Data that the SELLER could collect, may be used to identify any risk in the contracting and design of products or in the case of reports or reports and compliance with the requirements of competent authorities. Therefore, I give my express consent for its treatment in the terms indicated above.

III. Means to exercise the rights of access, rectification, cancellation, and opposition (ARCO Rights)

The personal data of the owner will be kept strictly confidential in accordance with the security, administrative, technical, and physical measures that the SELLER has implemented for this purpose, its illegal disclosure being prohibited and limiting its use to third parties, in accordance with the provisions of this Notice of Privacy.

According to the Personal Data Law, the owner has the right to exercise their ARCO Rights, to access their personal data, and to rectify, cancel and oppose their treatment.

To exercise the ARCO Rights, the owner must submit to the Treatment Manager, a request that must contain and accompany, at least, the following:

  1. The name of the owner, identification of the contract, and address or any means to communicate the response to the request.

  2. The documents that prove the identity or, where appropriate, the legal representation of the owner.

  3. The clear and precise description of the personal data on which you wish to exercise any ARCO Right.

  4. In the case of requesting a rectification, the documentation that supports the requested rectification must be attached.

  5. The SELLER reserves the right to request additional information and/or documentation to that mentioned to meet the request.

  6. The SELLER will respond to the request received within a period that may not exceed 20 (twenty) calendar days from the receipt of the request and will be made effective, within a period that may not exceed 15 (fifteen) days. Calendar days after the communication of the response to the request. The aforementioned deadlines may be extended for a single occasion, provided that the circumstances of the case justify it.

  7. The SELLER may deny the exercise of ARCO Rights in the following cases:

  • When the applicant is not the owner of the personal data or the representation is not duly accredited.

  • When you do not have the applicant's personal data,

  • When the rights of a third party are injured.

  • When there is a legal impediment or the resolution of a competent authority that restricts the exercise of ARCO Rights.

  • When the rectification, cancellation or opposition has been previously carried out.

The SELLER will not be obliged to cancel personal data when: (i) it refers to the parties to a contract and is necessary for its development and fulfillment; (ii) must be treated by legal provision; (iii) are necessary to comply with an obligation legally acquired by the owner.

The obligation of access to the information will be fulfilled by the SELLER, when it makes the personal data available to the owner directly at the address established in section I of this Privacy Notice.

 

 

IV. Transfers of personal data that, if applicable, are carried out

The SELLER may transfer data to national or foreign third parties in order to:

  • Fulfill obligations derived from contractual relationships.

  • Comply with agreements related to corporate restructuring, including merger, split, consolidation, sale, liquidation or transfer of assets, among others.

  • When the third party is part of the same Business Group as the SELLER.

Notwithstanding the foregoing, the treatment of Personal Data and even Personal, Patrimonial, and/or Sensitive Data will continue to be subject to this Privacy Notice and the third party will assume the same obligations that the SELLER assumes in this Privacy Notice for which the SELLER will inform said third party of this Privacy Notice.

If you do not express your opposition in writing in the form and terms mentioned in this Privacy Notice for the transfer of your personal data, your consent will be understood as granted.

In accordance with the Personal Data Law, the SELLER may carry out transfers of the Personal Data of any owner, without requiring their consent, in the cases indicated in article 37 of the Personal Data Law.

 

 

V. Changes to the Privacy Notice

The SELLER reserves the right to make changes or updates to this privacy notice at any time.

The notice and, where appropriate, the modifications will be available through any of the following means: (i) visible advertisements at the address of the SELLER indicated in section I of this Privacy Notice; (ii) by sending by certified mail or through courier companies, either independently or attached to the account statement; or (iii) brochures available in our office.
